Developments, Trends and Practical Implications

After a two-year lull,
litigation activity involving directors and officers
took a dramatic upturn in the second half of 2007, and
this heightened activity has continued in early 2008. A
significant factor in the increased litigation frequency
is the upsurge in lawsuits relating to the
subprime meltdown. But the
subprime crisis is only one
of several important trends driving the litigation. This
seminar will take a look at the important litigation
trends and developments in 2007 and so far in 2008,
including a review of the kinds of lawsuits that are
being filed, the litigants who are being targeted, and
the legal theories that the claimants are advancing. The
seminar will also consider the practical implications
for companies and their senior officials interested in
avoiding the unwanted attention of plaintiffs’ lawyers.
